PostHeaderIcon complex issue over who owns the tennis courts in our condo???

Several years ago I purchased a condo unit with shared facilities…outdoor swimming pool, tennis courts in a 3 building complex. A year ago the city dug-up the road in front of our tennis courts due to a pipe burst. The tennis courts got dug up also and then some stones were thrown on the area to cover up the dug-up part of the tennis court. No new paving was undertaken. Upon investigation …it appears the tennis courts are registered to the building who went bankrupt at the time I purchased my unit …that was 10 years ago . The tennis courts upon a title search being done indicate that the BUILDER owns the tennis courts. I cannot find the Builder’s existence to-day. How do we change over the ownership of the tennis courts to the condo complex ownership??? We cannot find the Builder therefore do we own it automatically???? What legal procedures do we need to undertake now???

The answer to this question will likely depend on where your condo is located, and may vary widely depending on location. You should seek the advice of a lawyer in your area.

Generally speaking, the community’s CC&Rs will specify how the common areas are to be titled after the builder is done working on the property. Title will generally transfer to the community association automatically, which is usually triggered by a specific event (like the last unit is sold).

If the necessary title transfers were not made, the association may need to seek redress through the courts to quite title. This is a complex issue, which should be accomplished through competant legal counsel in your area.

On the other hand, if you just want to see that the tennis courts are repaired, the actual ownership may not matter, the association can simply pay to have the repairs made. In the event that the builder, or someone else, is the real owner, the most you may hope for in pursuing the owner to do the repairs would be a transfer of title to the association, which would make the association responsible for the repairs anyway.

In some cases, the city could be responsible for the repairs, but you will have to seek local counsel to address that issue.

PostHeaderIcon Why can’t Wimbledon just rig-up some plastic roofs over the tennis courts?

Why didn’t they build a centre court with a moveable roof in the first place? It’s not a huge stadium is it… it’s pretty tiny compared to a football stadium.

And why can’t they just rig up some makeshift roofs all over the other outer courts?

As I see it… you’d only have to install a few posts around the courts… with the posts on one side slightly lower than other side to allow water to drain… and then rivet in some tough thick tranparent plastic. Job done for around £10,000 ?

its a lot more work then you think. Its a very difficult shape to dome which is why they had to take it almost completely off. They decided against a new one which could have been done in no time because of tradition. So were stuck with it for 2 more years!

If you have a driveway to your home the string a net or a couple of ropes across it.

If you have land space then you can make a grass court rather easily. If you do have some money and land room then buy tarmac and lay it for a court.

the answer to your first question is about $21, 000 on average. you then might want to install lights(average$2000) and add fences around the court.

for an answer to your second question, its all about personal choice. a synthetic grass court(don’t go with proper grass as you always have to mow it and keep the grass green) is more high maintenance then a concrete court because you have to add sand every so often and then bag the courts after use.

concrete courts(hard courts) are less work but u need to buy a squidgee(it is a rubber thing that removes water because the concrete courts dont absorb water like synthetic grass courts.) my opinion, buy a hard court less maintenance and funner to play on.

If you are looking for economic then building an outdoor court of any type will be tough. However, If you want to build a nice court without emptying the bank account perhaps try building a court with a shelter over top of it as apposed to a surrounding wall court…I know that wont take care of the wind and it wont be a true indoor playing surface however it wont cost nearly as much. Other than that i suggest contacting a tennis court construction company that is local to you. You can find one in your local telephone book under tennis-court construciton(usually) good luck!

Clay or Asphalt will be the price factor as asphalt will be the cheaper of the hard surface.

MUCH of it you can do yourself, up to the hot asphalt. Don’t use cold pack as it will not last as long.

Pricing can be hard to pinpoint because it depends on how much excavation you need.

Call around for pricing and don’t necessarily go for the lowest, but for the best level of service.

Hi again! Well the cheapest surface is probably macadam, (similar to tarmac). It would cost from £15,000 – £20,000 to build a court from complete scratch……….

I understand maybe a pro tennis player doing this but is it that much of a coincidence that about a quarter of mansions have a tennis court? Is that prime piece of property really worth wasting over a tennis court? Are they THAT much of a tennis enthusiast that they just HAVE to have a court to play on taking up half of their backyards?

Well if you play tennis and find you like it you always want to play and having the convenience of your own court is nice. Also tennis considered a gentleman’s sport. A sport for ladies and gentlemen…. hence rich people and mansions have tennis courts…. since many people believe tennis is a sport of the high class because of it being a gentleman’s sport and the Etiquette.
